Attorney Son Heung-Soo delivered a two-hour lecture on "Civil Execution Practice Issues Related to Trusts" to approximately 100 employees and officers of Korea Trust Co., Ltd. on October 18, 2023.


The lecture addressed the following issues: (1) the specific extent to which a trustee as a third-party debtor can be indemnified in the event of a (provisional) attachment of a portion of the beneficial interest of a trustee who is a creditor of the attached rights, (2) the response of a trustee as a third-party debtor in the absence of attached rights, (3) the effect of a (provisional) attachment on the beneficial interest of a trustee, and (4) specific ways in which a trustee can make a deposit with a depository and be exempted as a third-party debtor. The lecture was conducted in such a way as to answer questions received in advance on various specific and practical issues in civil execution practice relating to trusts, together with explanations of the theoretical background. The lecture was followed by a Q&A session with the employees and officers of the company.


Shortly after opening his practice as a lawyer, Attorney Son has been serving as an adjunct professor at Korea University Law School since the second semester of 2016. He has continued to give lectures on the theory and practice of civil execution law and insolvency law, and has recently expanded his practice to include civil execution and preservation orders related to trusts, such as a lawsuit to confirm a trustee’s right to withdraw funds in a case where a trustee is a third-party debtor.
