Attorney Son Heung-Soo gave a presentation on “Legislative review of the legislative bill and amendment bill of the Justice Department’s Movables and Claims Security Act for introduction of en bloc enforcement” on June 18, 2022 at a symposium jointly hosted by The Association of Korean Civil Judgment Enforcement Law Association and the Supreme Court of the Republic of Korea, commemorating the 20th anniversary of the enactment of the Civil Execution Act. The presentation provided a legislative review of the government’s amendment bill that seeks to provide en bloc enforcement of security established en bloc over different types of subject matters, including corporeal movables, claims, intellectual property rights, etc. for the benefit of small and medium-sized companies that lack security.

The symposium was held for two days, from June 17 to 18. On the 17th, Professor Yoshiatsu Uchida of Waseda University of Japan talked of “Egalitarianism and priority concerning civil execution: From the perspective of obtaining effectiveness of title of debt;” Professor Hiromasa Nakajima of Senshu University of Japan spoke of “Legal issues concerning crypto assets under the Civil Execution Act;” Attorney Cho Kwan-Haeng spoke of “Issues concerning auction of partitioned buildings (especially open commercial building) under the Condominium Building Act and measures for improvement;” Professor Ham Young-Ju of Chung Ang University Law School spoke of “Issues concerning auction of real estate of which its right to land is unregistered and measures for improvement;” Professor Choi Kwang-Seon of Chonnam National University Law School spoke of “Re-establishment of the relationship between civil execution and compelled collection procedure;” and Judge Park Jin-Su (Senior Judge, Seoul Central District Court), Professor Kang Yoon-Hee of Korea University Law School, and Professor Jeong Sang-Min of Jeju National University Law School took part in the panel discussion, with Professor Jeon Byung-Seo of Chung Ang University Law School serving as the moderator.

On the second day of the symposium, Professor Kang Ku-Wook of HUFS Law School spoke of “Illusion and reality of creditors’ egalitarianism under the Civil Execution Act;” Judge Lee Hyun-Jong (Seoul Central District Court) spoke of “Compulsory execution against virtual property;” Attorney Son Heung-Soo of Barun Law spoke of “Legislative review of the legislative bill and amendment bill of the Justice Department’s Movables and Claims Security Act for introduction of en bloc enforcement;” Judge Noh Jae-Ho (Senior Judge, Gwangju District Court,) spoke of “Issues concerning the current provisional attachment and interim injunction carried out against a contested subject matter and measures for improvement;” Professor Jeon Hyu-Jae of Sung Kyun Kwan University Law School spoke of “Measures for improvement of the interim injunction system and the practical affairs thereof to set interim status;” and Judge Jeon Bo-Seong (Senior Judge, Seoul Central District Court), Professor Park Seong-Eun of Keimyung University (Department of Law), Judicial Aide Park Jun (Incheon District Court), Judicial Aide Min Dong-Keun (Seoul Central District Court) and Judicial Scrivener Lee Chon-Kyo took part in the panel discussion, with Judge Hong Dong-Ki (Senior Judge, Suwon High Court) serving as moderator.
